National Database Registry

Pursuant to the applicable laws in Argentina, ESSARP has registered its databases with the Dirección Nacional de Protección de Datos Personales (National Personal Data Protection Office), which is part of the Ministry of Justice and Human Rights Structure.



The Dirección Nacional de Protección de Datos Personales -DNPDP- is the Federal agency that was created to ensure an effective protection of personal data.

This agency is responsible for the Database Registry, designed to obtain and monitor data bases.
It assists and advises individuals by receiving claims and complaints against those responsible for the registries, files, databases or databanks in case of breach of information, access, correction, updating, deletion and confidentiality in the treatment and management of personal data.
In this regard, the purpose of the Registry is to investigate whether the database at issue complies or not with the principles set forth in the law and its regulatory provisions.

The DNPDP will inform you about:
    1. The existence of a database.
    2. Why a database collects data and what for what purpose.
    3. Name and address of the person responsible for the database.


What Can I do in Case of Breach of My Rights?

If a database does not meet the requirements set forth in the Personal Data Protection Act, the data owner has the right to:

Report the claim to the DNPDP

If the claim is upheld, the DNPDP can request the relevant administrative sanctions against the registry, file, database or bank (Section 31, Law Nº 25 326).

It is important to highlight that any claim filed with the DNPDP is for the sole purpose of reporting any deficiency or breach of the applicable personal data management rules and regulations, by the files, registers, databases or databanks.

his will help the DNPDP, as the controlling authority over the registers, files, databases or banks, to seek the protection of the rights contemplated in the law.

Legal Action of Habeas Data (Law Nº 25.326, Title VII)

This action can be admitted to obtain personal data stored in files, records or data banks, whether private or public, which are intended to provide reports and information about the purpose thereof.

In case of false or discriminatory information, you can request the deletion, amendment, confidentiality or updating of your data. (Section 33)
